Event Review: New Visa Regulations


On Thursday 24th of February the British Chamber of Commerce Southwest China held a seminar regarding the visa regulations. It was great to see the signicant amount of attendants who showed interest in the new visa regulations. The seminar was a great success, as everyone left with a better understanding of the new visa regulations than before.

Followed by Spokesperson Ms. Zhang Yi,Partner Attorney-at-Law from Zhong Lun Law Firm, and Executive representative of the British Chamber of Commerce Southwest China introducing the new visa regulations. 

Afterwards, Mr. Peng Liang from the Bureau of Exit-Entry Administration of Chengdu Municipal PSB informed the audience about exit-entry regulations.

Furthermore, a Q&A session was held with Mr. Dai Qi from Foreign Expert Bureau, Mr. Peng Liang, and Ms. Zhang Yi answering questions.

 After the Q&A session, the spokespersons engaged with the attendants  to fully clarify all of their questions.

▶ Under the new system, the following two sets of old licenses will be integrated into a new set of licenses, with a unique license code:

  •    Old licenses: “Permit for Foreign Experts Working in China”, “Foreign Experts Certification” and “Permit for Foreigners Working in China”, “Foreigners’ Employment Certification”.   
  •    New licenses: “Notification Letter of Foreigner’s Work Permit in China”, “Permit Certification for Foreigners Working in China”.

▶ The new policy will divide the foreigner who works in China into 3 categories.   

     Class A is Foreign High-end Talent

     Class B is Foreign Specialists,

     Class C is Foreign Ordinary Workers.

▶ Under the new system, the “Implementation Plan” clearly put forward that China will implement the “quantitative limit” measures for foreigners working in China.

  • Class A applicants—— no limitation
  • Class B applicants will be restricted according to the market demand
  • Class C applicants will be strictly restricted by the quota management.

▶ The “Implementation Plan” adopts the “point-based evaluation system” to decide the category of foreigners.

Class A- >85

Class B- >60

Class C- <60

*With an age limit of 60 (apply to both male and females)

Employers can log in the “Foreigners work in China Management Service System”, submit the application information online, and provide relevant electronic materials.

 ▫ Proof of work qualification

 ▫The highest degree (academic) certificate or the relevant approval documents or professional qualification certificate

 ▫ Certificate of No Criminal Record issued by applicant’s nationality state or long-time residence state

 ▫ Applicant ‘s medical certificate

 ▫ Employment contract or proof of employment

 ▫ Applicant passport or international travel document

 ▫ Full-faced photo within 6 months

 ▫ Relevant materials of accompanying family members

▶Any extension of residence permit shall be renewed 30 days before the expire date.

  • Visa application requires 7 working days, residence documents requires 15 working days.
  • Rush service is provided without extra charge

▶Punishment for illegal stay: fine 500rmb/day up to 10,000rmb

▶Punishment for altering registration: warning and fine no more than 2000rmb

▶ Punishment for illegal work: Foreigners who work in China illegally shall be fined not less than RMB 5,000 but not more than RMB 20,000 yuan; where circumstances are serious, they shall be detained for not less than five days but not more than fifteen days and shall also be fined not less than RMB 5,000 yuan but not more than RMB 20,000 yuan.
